We (UAB ‘PRS Sportas’) respect your privacy and are committed to protecting it in accordance with this Privacy Policy (hereinafter referred to as ‘Privacy Policy’). In this Privacy Policy, you will find information about the processing of your personal data. We are committed to being transparent by providing clear information about which of your personal data are processed, the purposes of processing, the period of data retention, as well as the legal basis for data processing and other information that we must provide in accordance with applicable laws.

1. What personal data do we process and why?

The categories, purposes, and legal basis for processing your personal data that we handle are as follows:

1.1 Photos and/or videos taken during events or activities.

• Visual (photo or video in digital format).

• If necessary, for a specific event: name, surname, email address, or phone number.

Your consent and/or our legitimate interests, which are: to disseminate information about our company and its activities.

Legal Basis for Data Processing

We process your personal data in order to disseminate information about our company and its activities, and to provide you with the opportunity to participate in our events and utilize the outcomes or products.

We receive information about you when you:

1. participate in events or other activities;

2. participate in our contests;

The events are open to everyone, and participation is not mandatory. Whether you participate or not is up to you. If you want to avoid any possibility of being photographed or filmed, you can choose not to attend our public events or contact us to request the removal of your image from materials intended for communication. By participating in events, you should understand that your image will be photographed or filmed and may be used to disseminate information about our company’s activities.

Your name, surname, phone number, or email address are collected only when we want to compile a list of participants or when we want to inform you about the opportunity to receive or collect the results of our collaboration.

Your name, surname, phone number, or email address will be kept until the end of the event. Your image (photo or video) from events or activities will be stored for 10 years from the actual date of the event.

We transfer your personal data to our partners who provide us with photo or video editing services, printing services, to advertising agencies, data processors, for example, those who provide us with IT maintenance services, and others.

1.2 Public Relations

• Social media (e.g., Messenger, Viber, WhatsApp, etc.) account or another communication channel (e.g., Skype) account

• In certain cases, to ensure your health and safety, we may request additional information, such as about food.

Legal Basis for Data Processing

We process personal data based on your consent or our legitimate interests, which are considered to be public relations.

We process your personal data for the purpose of distributing relevant information to the general public or specific groups. If you would like to receive business news from the company, we will collect certain information about you. We use this data to send you company news such as press releases by email, invitations to events by email, or deliver printed materials to the specified address, and in urgent cases to contact you by phone, through social networks (e.g., Messenger, Viber, WhatsApp, etc.) or other communication channels (e.g., Skype), to provide you with important company information that would be relevant to the public.

We receive information about you when you provide us with personal data expressing a desire to receive the company’s business news by email to our public relations or marketing staff, or when you agree to receive news by participating in company events or by directly communicating with company representatives.

You are not obligated to provide all personal data, only those you wish to use in communication with us (for example, you may provide just the company name and email address). If you do not provide the data, you will not receive company news. If the information we send is not relevant to you, you can opt out by expressing your decision via email to company employees.

Your personal data will be stored until you unsubscribe from the company news or otherwise request us to delete your data, or until we determine that the recipient is no longer reachable (e.g., receiving an automatic notification that the person no longer works at a specific media company or that such an email address no longer exists) or for 5 years from registration. The list of media representatives who participated in the event will be stored for 2 years after the event ends, and others who participated in the event will be stored for 1 month after the event ends. If additional data were collected in certain cases, such as data about food, such data will be stored until the end of the event.

Personal data is disclosed to companies that provide services to us, for example, in some cases, we may transfer your personal data to the company’s public relations agency to share information on our behalf, to data processors, such as those who provide us with IT maintenance services, and others.

1.3. GetPadel Partneriai

• Newsletter interaction (information on whether the newsletter was read, when it was read, how many times it was read (or opened), whether it was forwarded to anyone, the operating system used, the email server, including its location)

Legal Basis for Data Processing

To maintain business relationships, manage and execute GetPadel activities intended for companies and organizations, sign contracts, execute them, and/or make contact regarding various questions about contract execution with GetPadel clients, we need to process the personal data of GetPadel clients (who may also be individuals—entrepreneurs), their employees, or representatives.

Additionally, having received the consent of a GetPadel partner/client, we send information about our products, services, offers, and advertisements intended for companies and organizations. Moreover, to better understand whether the information we send is relevant, we collect data on newsletter interaction (information on whether the newsletter was read, when it was read, how many times it was read (or opened), whether it was forwarded to anyone, the operating system used, and the email server, including its location). In such cases, personal data will be stored until the subscription to direct marketing messages is cancelled, but no longer than 12 months after the last interaction with the newsletter.

If a contract was signed, the personal data of GetPadel clients, their employees, or representatives will be stored for 10 years from the end date of the contract’s validity. If the contract specifies a warranty period that extends the mentioned storage period, then all personal data related to the contract will be stored until the end of the warranty period. If the contract is needed during a legal proceeding, which extends the specified storage period, then all personal data related to the contract will be stored for one year from the final decision by the relevant authorities. If no contract was signed, the personal data of GetPadel clients, their employees, or representatives will not be stored.

We may disclose your personal data to auditors, financial and legal consultants, companies that provide home delivery services, data processors such as archiving companies, the company whose system we use to send newsletters, IT maintenance companies, and others.

Legal Basis for Data Processing

We process personal data in order to fulfill a contract with you or to enter into one, as well as to comply with the legal obligations applicable to us.

However, if we store your personal data to protect our legal rights, for example, in the event of a legal dispute, such processing of personal data is based on a legitimate interest aimed at protecting our rights in such cases.

We process your personal data in order to enter into or execute a contract with you, oversee its fulfillment, carry out payments according to the contract, and resolve complaints related to the formation, execution, and/or termination of the contract.

We also process your personal data to ensure the proper execution of our tax obligations, i.e., to verify whether, at the time of contract formation or service provision (if no contract was formed), you held a business license or provided services under an individual activity certificate, and whether you were authorized to provide services to legal entities during the contract formation or service provision (if no contract was formed). Additionally, personal data are necessary for the proper fulfillment of our legal obligations: to calculate taxes and to declare to tax authorities information about the services received from you or payments made to you.

We also process your personal data to recover debts and/or other payable amounts as necessary, and, if needed, to fulfill our legitimate interest by asserting, presenting, and defending legal claims.

We receive information about you when you provide it to us while forming a contract and/or providing services (if no contract is formed) under a business license or an individual activity certificate. We also collect your personal data from the Tax Inspection’s database to verify whether you have a valid business license.

You must provide us with your name, surname, date of birth (or personal identification number), VAT payer code (if you are a VAT payer), address, business license number or individual activity certificate number or individual company code, and contact information. If you do not provide the required mandatory information, we will not be able to enter into a contract with you and purchase the services you provide.

Your personal data will be stored for 10 years from the date of contract expiration. If the contract specifies a warranty period that extends the indicated storage period, then all personal data related to the contract will be stored until the end of the warranty period. If the contract is required during a court process that extends the specified storage period, then all personal data related to the contract will be stored for one year from the final decision of the relevant authorities. If you provided services to us but no contract was formed with you, your personal data will be stored for 10 years from the date of service provision and the issuance of the accounting document.

In the case of copyright and intellectual service contracts, all related documents, including works acceptance certificates, will be stored for 50 years from the end of the contract validity.

We transfer your personal data to banks, government agencies (most commonly tax authorities), auditors, document archiving companies, legal and financial advisors, debt collection companies, and data processors, such as those who provide us with IT maintenance services, etc.

1.4.2. Invoices issued to and received from individuals include:

Legal Basis for Data Processing

We process your personal data to comply with the legal obligations applicable to us.

However, if we store your personal data to protect our legal rights, such as collecting debts and/or other payable sums, such processing is based on a legitimate interest to protect our rights.

We process your personal data to properly issue and receive invoices, i.e., according to legal requirements, and to ensure accurate information is provided to tax authorities. We also process your personal data to collect debts and/or other payable sums when necessary and, if needed, to fulfill our legitimate interest by asserting, presenting, and defending legal claims.

We receive information about you when you provide it to us for the purpose of issuing an invoice for our purchased goods and services or when you submit such an invoice to us.

When issuing invoices, you must provide your name, surname, VAT payer code (if you are a VAT payer), address, and individual company code. If you do not provide the required mandatory information, we will not be able to issue you an invoice.

Your personal data will be stored for 10 years from the date the invoice is issued or received.

We transfer your personal data to banks, government agencies (most commonly tax authorities), auditors, document archiving companies, legal and financial advisors, debt collection companies, data processors such as those who provide IT maintenance services, etc.

1.4.3. Transfer-Acceptance Acts for Gift Cards, Prizes, and Other Gifts.

Legal Basis for Data Processing

To comply with our legal obligations,

we process your personal data to ensure the accurate fulfillment of our tax obligations: to calculate taxes and to report the benefits granted to you to tax authorities.

We receive information about you when you receive a gift card, prize, or other gift for free and you sign the transfer-acceptance act.

You must provide us with your name and surname, personal code, or passport number, or personal identity card number, or permit to reside in the Republic of Lithuania number. If you do not provide the required mandatory information, we will not be able to ensure the correct execution of our tax obligations, and thus we may refuse to issue you a gift card, prize, or other gift for free.

Your personal data will be stored for 10 years from the date of the transfer-acceptance acts.

We transfer your personal data to government agencies (most commonly tax authorities), auditors, and parcel delivery companies if the prize and/or other gift is delivered to your home and data processors, such as document archiving companies.

1.5. Personal data of employees or representatives of business partners or potential business partners:

Legitimate interests to establish and execute contracts made with business partners and to create new business relationships with potential business partners:

We process your personal data, as an employee or representative of a business partner, to sign contracts, execute them, and/or communicate regarding various issues related to contract performance.

We process your personal data, as an employee or representative of a potential business partner, to establish new business relationships (e.g., receiving commercial offers in our competitions).

We receive your personal data from you or from our business partner or potential business partner.

Your personal data, as an employee or representative of a business partner, will be stored for 10 years from the end date of the contract validity. If the contract specifies a warranty period that extends the storage period, then all personal data related to the contract will be stored until the end of the warranty period. If the contract is required during a court process that extends the storage period, then all personal data related to the contract will be stored for one year from the final decision of the relevant authorities.

Your personal data, as an employee or representative of a potential business partner, will be stored until the end of the competition.

We may disclose your personal data to auditors, government agencies (most commonly tax authorities), financial and legal consultants, and data processors, such as an archiving company, IT maintenance companies, etc.

1.6. Games and/or Competitions

Depending on the game and/or competition, there may be one or several:

• Receipt date

• Other data related to the contest or game (e.g., a photograph, etc.)

In case of winning:

• Personal identification number or passport number, or identity card number, or permit to reside in the Republic of Lithuania number

• Value of the prize and/or other gifts

• Signature

• Address (in cases where the prize or other gift is delivered to a home)

Legal Basis for Data Processing

Your consent.

In case of winning, the legal basis for data processing is our legal obligation.

If a complaint is received about the game and/or competition, the processing of personal data in this case is based on a legitimate interest to protect our rights.

We process your personal data for organizing, conducting, administering games and competitions, determining winners, announcing them, awarding prizes and/or other gifts, and also in case of winning, data are processed to ensure the correct execution of our tax obligations: calculating taxes and declaring information about the benefits provided to you to tax authorities. If a complaint is received about the game and/or competition, personal data in this case are processed to assert, execute, or defend legal claims.

Participation in the game and/or competition is optional, but if you agree to participate, you must provide the personal data requested in the game and/or competition. Otherwise, you will not be able to participate. In case of winning, you must provide us with your name and surname, personal identification number or passport number, or identity card number, or permit to reside in the Republic of Lithuania number. If you do not provide the required mandatory information, we will not be able to ensure the correct execution of our tax obligations, and therefore we may refuse to issue you a prize or other gift.

We receive information about you when you agree to participate in a game and/or competition by filling out a registration form, or when you voluntarily agree to publicly provide your personal data in social network comments, messages, etc. You have the right at any time to withdraw your consent to collect and process your personal data, without affecting the legality of the data collection and processing before the consent withdrawal. Upon withdrawing your consent, the participant in the contest and/or game is removed from the participant list and no longer participates in the contest and/or game. By participating in a contest and/or game, you agree that in case of winning, the receipt number and date, or social network username may be publicly announced on the contest and/or game website or on social networks.

We may also use a program based on automated decision-making to manage the registration of the game and/or competition and/or to determine winners. If you do not wish to be subject to automated decision-making, you will not be able to participate in the game and/or competition.

By providing personal data, you confirm that the personal data are accurate and correct, and that you are at least 18 years of age. If you notice any inaccuracies, correct them immediately.

Personal data of participants in a game and/or competition will be stored until the day the winners are determined or no longer than 5 business days after the deadline for submitting a complaint about the contest and/or game. Personal data may be stored longer if a complaint about the games and/or competitions is received. In such cases, personal data will be stored until the complaint is resolved. In case of winning, personal data will be stored for 10 years from the date of signing the prize or other gift transfer-acceptance act.

We transfer your personal data to government agencies (most commonly tax authorities), auditors, parcel delivery companies if the prize and/or other gift is delivered to a home, and to data processors, such as document archiving companies. In some games and/or competitions, we allow you to upload your content, such as photographs, in which case the information you provide or publish becomes public information.

2. To Whom We May Disclose Your Personal Data?

We may disclose your personal data to:

a) Companies we work with

Personal data are disclosed to companies that provide us services and are mentioned in each processing purpose. All these companies must ensure the same protection of your personal data, cannot use them for unauthorized purposes, and must ensure that their partners act similarly.

b) State and municipal institutions, other persons performing functions assigned to them by law

We transfer your personal data to state and municipal institutions and other persons performing functions assigned to them by law, upon their request or to pursue our legitimate interest to assert, execute, or defend legal claims.

3. Personal Data Protection

We handle your personal data responsibly:

a) Security

We use technical and organizational security measures to protect your data. Data are securely stored and accessible to a limited number of persons.

4. Your Rights

You have the following rights:

a) the right to receive information about whether your personal data are being processed, and if such personal data are being processed, the right to access your personal data. Therefore, we inform you in advance in this privacy policy. If you have questions or want to learn more about how your personal data are processed, contact us;

b) the right to request us to correct inaccurate personal data;

c) the right to delete your personal data if you think there is no need for us to keep them any longer, or you had given consent and decided to withdraw it. This right does not apply if data processing is related to the freedom of expression and information, legal obligations, or the establishment, exercise, or defense of legal claims;

d) the right to receive or transfer your personal data to another company (the right to data portability). This right applies when personal data are processed automatically based on your consent or upon signing a contract;

e) the right to restrict the processing of personal data under certain circumstances. This means that we will continue to store your data but temporarily will not be able to process them. When might this be necessary? For example, if inaccurate data are detected. You likely would not want them processed until they are corrected;

f) the right to object to the processing of your personal data when the processing is based on the legitimate interests of us or a third party. You can use this right if you believe that your personal interests are more important than our legitimate interests in processing your data;

g) the right to object to the processing of your personal data for direct marketing purposes, including profiling;

h) the right to withdraw consent to process your data at any time.
